Terms of Service
These Terms govern access to Phoenix Command, operated by Phoenix Limited in St. John's, Antigua and Barbuda, including its dashboard, mobile application, trade-journal and analytics features, user-directed AI review, themes, and related Phoenix software. They do not offer brokerage, custody, trade execution, funded-account, prop-firm, or signal services.
Service, eligibility, and electronic agreement
Phoenix Command provides software for trade journaling, performance analytics, account organization, user-directed AI review, and related digital features. For any product identified at checkout as Phoenix Journal & Analytics, the purchase unlocks only the Phoenix software features expressly described at checkout. No purchase grants broker access, trade execution, operation or licensing of a trading bot, trading signals, funded-account or prop-firm access, consulting, or cash-equivalent or stored-value rights. You must be legally able to enter this agreement. By selecting the acceptance box, creating an account, purchasing an item, or using the service, you agree that this electronic record and your electronic acceptance are intended to form a binding agreement to the extent permitted under applicable law.
No investment advice and trading risk
Phoenix Command is not a broker, dealer, investment adviser, financial planner, fiduciary, signal provider, or custodian. Nothing in the service, including AI output, bot activity, alerts, market data, coaching, community content, or performance displays, is investment, legal, tax, or financial advice. Trading involves substantial risk, including loss of capital. You make every trading decision independently and remain responsible for evaluating any information before acting.
Your account and data
You are responsible for accurate account information, safeguarding credentials and devices, and activity under your account. You may connect or enter only data you have the right to use. You must promptly notify us of suspected unauthorized access. We may apply reasonable authentication, entitlement, fraud, and security checks before enabling or continuing access.
Licence and intellectual property
Phoenix Limited grants you a personal, limited, revocable, non-exclusive, non-transferable licence to use the service for its intended purpose while your access is active. Phoenix Command, its software, content, designs, brand, and related intellectual property remain owned by Phoenix Limited or its licensors. You may not copy, sell, rent, sublicense, scrape, reverse engineer, circumvent access controls, or create competing derivatives except where applicable law expressly permits it.
Acceptable use
Do not misuse the service, attempt unauthorized access, interfere with security or availability, upload unlawful or infringing content, introduce malware, automate abusive requests, resell access or data, impersonate another person, or use the service in violation of applicable law or broker, prop-firm, exchange, or platform terms.
Access, suspension, and termination
Access tiers, features, trials, credits, cosmetics, and integrations may change, be suspended, or be withdrawn where reasonably necessary for security, fraud prevention, legal compliance, maintenance, service integrity, or a material breach of these Terms. Where practical, we will give notice. Termination does not create a right to a refund except where applicable law requires one.
Payments and digital items
You authorize the applicable charge and must confirm the selected product, account, quantity, renewal terms, and price before checkout. Phoenix uses Paddle as its checkout and merchant-of-record provider for supported purchases. Paddle may issue receipts, calculate and collect applicable taxes, provide customer billing tools, and apply its own buyer terms, refund process, fraud controls, and chargeback procedures. Taxes, currency conversion, bank fees, and third-party charges may apply. A Phoenix Journal & Analytics subscription unlocks Phoenix software only; it is not payment for execution, signals, bot operation, prop-firm access, consulting, or stored-value credits. Any separately offered cosmetic entitlement is a non-cash digital feature tied to the purchasing account. Promotions, giveaways, discounts, and access grants are non-transferable and have no cash value, subject to applicable law, Paddle's applicable terms, and any mandatory consumer rights.
Third-party services
The service may rely on or link to third-party providers, including authentication, hosting, payment, AI, market-data, broker, community, and mobile-platform services. Their availability, terms, and privacy practices are outside our control. Your use of a third-party service may also be subject to that provider's terms.
Disclaimers, indemnity, and liability
The service is provided on an as-available basis to the maximum extent permitted by law. We do not guarantee uninterrupted service, market-data accuracy, AI accuracy, profitability, trade execution, compatibility, or availability of third-party services. You agree to indemnify Phoenix Limited against third-party claims arising from your unlawful use, your breach of these Terms, or your content. To the maximum extent permitted by law, Phoenix Limited is not liable for indirect, consequential, special, exemplary, trading, data, or lost-profit damages. Our aggregate liability for a claim is limited to the amount you paid to Phoenix Limited for the affected service in the twelve months before the claim, except where liability cannot legally be limited.
Governing law and disputes
These Terms are governed by the laws of Antigua and Barbuda. Courts with jurisdiction in Antigua and Barbuda have exclusive jurisdiction, subject to any consumer rights or forum rights that cannot legally be excluded. Contact support@phoenix-cmd.com before escalating a dispute so we can attempt to resolve it directly.
Changes and contact
We may update these Terms when the service, law, or risk profile changes. Material changes will be posted with an updated version and may require renewed acceptance before access continues. For support or legal notices, contact support@phoenix-cmd.com.
